Part 1 — Terms of Service

1. Acceptance

By creating an account or using the SMART CAT beta (the “Service”), you agree to these Terms. If you do not agree, do not use the Service. The Service is operated by COLLINS Consulting Group LLC (“we,” “us”).

2. The Service

SMART CAT provides (a) a “Regulatory Bulletin” that surfaces publicly available U.S. regulatory activity relevant to electromagnetic-spectrum work, and (b) an AI assistant for spectrum and regulatory questions. The Service is in beta: features may change, be limited, or be discontinued at any time, and availability is not guaranteed.

3. UNCLASSIFIED use only

The Service is authorized for UNCLASSIFIED information only. You must not input, upload, or transmit classified information, Controlled Unclassified Information (CUI), export-controlled/ITAR/EAR-restricted technical data, personally identifiable information of others, or any information you are not authorized to disclose. You are solely responsible for the content you submit.

4. Not professional advice; verify everything

SMART CAT is an informational tool, not legal, engineering, regulatory, or professional advice, and does not create any advisory or consulting relationship. AI-generated output and automated summaries can be wrong or incomplete. You must independently verify every citation, date, threshold, and figure against the primary official source before relying on it. You are solely responsible for decisions made using the Service.

5. Accounts

You must provide accurate registration information, keep your credentials secure, and are responsible for activity under your account. One account per person. We may suspend or terminate accounts that violate these Terms.

If you post, comment, or vote in the SMART CAT community forum (“User Content”), the following applies in addition to §6:

7. Ephemeral processing

Documents and inputs you provide for analysis are processed to deliver the Service and are not retained as source files beyond your session, except as described in the Privacy Policy (e.g., your saved chat history, which you can clear).

8. Government users (FAR)

If you access the Service as a U.S. Government user, the terms are subject to FAR 52.232-39 (Unenforceability of Unauthorized Obligations) and applicable federal law: any provision that purports to create an obligation on the Government in violation of the Anti-Deficiency Act or other federal law is unenforceable against the Government. Nothing here obligates the Government beyond authorized appropriations, and no automatic-renewal, indemnification, binding-arbitration, or unilateral-modification term applies to the Government.

9. Intellectual property

We own the Service, its software, and its branding. You retain ownership of the content you submit and grant us a limited license to process it solely to provide the Service. Regulatory source materials are the property of their respective issuing authorities.

10. Beta disclaimer; no warranty

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that output is accurate, current, or complete.

11. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or missed regulatory deadlines, arising from your use of the Service. Our total liability is limited to the amount you paid us for the Service in the three months preceding the claim (or, if the Service was free to you, US $100).

12. Termination

You may stop using the Service at any time. We may suspend or terminate access for violation of these Terms or to protect the Service. Sections that by their nature should survive (IP, disclaimers, liability, governing law) survive termination.

13. Changes

We may update these Terms; material changes will be posted here with a new date. Continued use after changes constitutes acceptance.

14. Governing law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws rules, except where superseded by federal law for Government users.

Part 2 — Privacy Policy

1. Scope

This describes what the SMART CAT beta collects and how we handle it. UNCLASSIFIED use only (see Terms §3).

We do not sell your personal information. Documents you submit for analysis are processed ephemerally and are not retained as stored files (see Terms §7). We do not knowingly collect classified information or CUI, and you must not submit it.

4. How we use it

To deliver and secure the Service, enforce usage limits, prevent abuse, improve the product, and send you service and launch communications you can opt out of.

5. Service providers (subprocessors)

We use trusted providers to run the Service. Your queries may be transmitted to them to generate responses; we share the minimum needed and do not sell data to them:

Your chat history is retained to your account until you clear it or delete your account; usage counters roll over by period. You can request account and data deletion (see Contact).

7. Cookies

We use a session cookie to keep you signed in. We do not use third-party advertising cookies.

8. Security

Data is encrypted in transit; access is restricted. No system is perfectly secure — do not submit anything you are not authorized to disclose, and never anything classified or CUI.

9. Your choices

You can clear your chat history, unsubscribe from emails, and request access to or deletion of your account data by contacting us.

10. Children

The Service is intended for spectrum and regulatory professionals and is not directed to anyone under 18.
